MERRILL, MI — A 38-year-old Merrill man is dead following a double shooting in the village Saturday, Dec. 14, according to police.

Saginaw County Sheriff William Federspiel said the two men were shot during a domestic dispute involving two men and a woman.

Both males are believed to be Merrill residents, Saginaw County Sheriff William Federspiel reported.

The Michigan State Police crime lab was called, and both were transported to hospitals. A 33-year-old male was transported to Ann Arbor and is listed in serious condition. The other male, 38-year-old John Wood of Merrill died from his injuries, Federspiel said.

John Wesley Wood suffered a fatal gunshot wound Saturday, Dec. 14, at a residence on East Saginaw near Melze in the village of Merrill, the Saginaw County Sheriff’s Department reported. Dave Averill, 33, also suffered a gunshot wound at the residence, Wood’s friends said. A woman at the residence called 911 after the shooting.

SAGINAW, MI — Prosecutors have charged a Merrill man with involuntary manslaughter in connection with the shooting death of his longtime friend.

Saginaw County District Judge M. Randall Jurrens on Wednesday, Jan. 8, signed a warrant that charges David D. Averill Jr. in the Dec. 14 death of John Wood.

Sheriff’s deputies were called to Averill’s house about 10 p.m., officials have said. Both men were transported to a Saginaw hospital, where Wood died, police said. Averill later was transported to Ann Arbor for treatment for his injuries, police said.

Averill’s arrest warrant alleges he killed Wood “during the commission of an unlawful act not naturally tending to cause death or great bodily harm” and lists that act as “careless discharge of a weapon and/or discharge of a weapon while intoxicated and/or as a result of the negligent omission by (Averill) to perform a legal duty.” The warrant lists that legal duty omission as “failure to carry a weapon in a safe manner.”

The warrant indicates the gun involved in the incident was a rifle.

Meanwhile, as David D. Averill Jr. sits in jail awaiting his next preliminary hearing date, he and his wife also are fighting a wrongful death lawsuit filed by John Wood’s mother.
